Nj eviction of adult child

27 year old lives at home in NJ. Has drug problems and is suspected of stealing items and cash from us. Refuses to leave when told to. How to legally get him out and restrain him from coming around

Hello jc:

You have no legal obligation to him, unless he pays rent or utilities and can prove it. I detect some apprehension. If you are concerned with a violent reaction then you must make sure you protect yourself. Go to your local courthouse and apply for a restraining order. Advise the local police department of your intentions and your fears. When he's not around, change the locks. Tell him that he may get his things as long as he's accompanied by a policeman.

If violence ISN'T a concern, give him three days and tell him that you're going to change the locks and put his stuff out.

IF he pays rent or utilities and can prove it, then you need to evict him according to your states landlord/tenant law. But he doesn't pay rent, does he? Nahhhh.
