    A mother's rights to her Newborn
    I'm currently 6 months pregnant, and well the father of the child and I recently split up. He's always claiming to take custody of the child or at least 50-50, I am very concerned there is going to be a big fight for this precious being that is soon to be born and I don't want that. I'm going to be breast feeding and I really don't think I would be able to survive with the baby with me half the time and the other half with the father. I need to know my rights. I am very upset and deeply concerned.

    No one, absolutely no one is going to take the baby away from you while you are nursing, no matter how long it takes to do that. As soon as the baby is born, he/she goes home with you and whoever is looking after you and the baby at the time until you are ready to deal with the delima.

    Your rights as a mother are protected. If you are unsure ask for a counsellor at the hospital after the baby is born and they will let you know your rights.

    Where are you located? Everyplace has their own laws. Some are stricter for infants defineed as under one year or twelve months of age and other areas aren't. So that will make a huge difference. Also how far apart do the two of you live? That will also make a difference but you can expect him to get visitation and it will continue to go up as the baby gets a little older it could end up to be about fifty-fifty. The child was created by two people two people will have rights and responsibilities toward that child.

    Well I live in Newfoundland, Canada and well I'm going to be breastfeeding too. The father of the baby is always threatening me with custody. He has the mental illness of depression and is taking many different meds to treat it, He has also been in the hospital due to this. To this day when he gets really upset he still says that he told me to have an abortion when I first found out and that when the baby is born he wants all the freedom that he can get, so is he really ready for this child?

    That will be up to a judge. All you can do is tell your side of the story to the judge and show as much proof of what you say as you possibly can to hope for supervised visitation for as long as possible.

    Unless there is some compelling reason that proves you are unfit, there is no way he will get more than visitation a few hours at a time. At least while you are breastfeeding.

    After that it will depends on whether you can show him unfit for unsupervised visitation.
