proving unfit parent

My niece is an admitted drug user. Her grandmother has had physical custody of her for 4 weeks now. Now her mother thinks she wants her back. No job, no money, possible criminal thief charges. What info do we need to prove unfit parent.

I would contact the Childrens' Aid Society in your area; that would be a good start explainin the situation of how you feel about the mother.

You're the Aunt, and you want to stop a drug using daughter from going back to her mother who has possible criminal charges???? Do I have that right???

You want to prove the mother is unfit??? Then YOU are applying for custody or guardianship???? Or the grandmother????? You're going to need to clairify for me.

In any case, you're going to need a lawyer. Of course, if she's unfit, all you need to do is prove it. You prove it by hospital records, CPS records, police records, school records, etc. Absent those, she doesn't appear to be unfit.
