no child support in year don't want ex to be involved with child.

My ex has not paid any child support in 1 year. I did not take him to court. I really don't want him to be involved with the child because he has uncontroled mental illness. What rights does he have? My new husband wants to adupt him well that be possable and how? Do I have any rights that well help me and protect my child.

If your ex will sign over his rights, your new husband can adopt,

Of course not wanting to sound wrong, if you had been going to court to make him pay, and he wants to not pay, he would be more likely to want to sign over, Since you have been lazy collecting your childs money for them, he has little reason to just give up rights.

Also if your ex has real mental illness, does he have the mind to sign over his right //

In order for your husband to adopt him, the biological father has to sign away his rights a the father.

What is his mental illness and has he been diagnosed? Was Child Support in your divorce decree? Has he seen the child in the last year? How old is your child and how does he/she feel about their Father?
