How hard is it to get year on year off custody of a child who lives out of state? It is financially hard to see her on our time because she lives 12 hrs away. What would I have to prove in court to get this? Are we wishful thinking?

I really don't think a Judge would go for that because it would be too hard on the child to establish any consistent life. She would have to be away from her one set of friends every other year, adjust to two different schools and things like that.
Most likely in a situation like that I would guess the Judge would have the primary custodial parent have the child during the school year and give the other parent the summers and maybe some holidays.

I agree with nohelp4u in what they are saying. Your only other option would be to move as close as possible to your child for more time resembling a 50/50 custody. Depending on where you live you may need a parenting plan before you go to court. Also it might be easier to go through mediation first then have a court stamp its approval on the plan you both agreed to. But no court I believe will send a child from one home to another on a year by year basis. Good Luck

Hello baby:

You're not going to get that kind of custody arrangement. It will absolutely disrupt your childs life. You should be aware that all matters concerning your childs case will be decided based upon your child's welfare - not yours.

Given the above, if you had court ordered visitation, and the other parent moved out of state without the courts approval, you can have them brought BACK so that your child has the benefit of BOTH parents.

If you're the one that moved, your child is outta luck. Move back.

Yes, about the only split custody is where the two parents normally happens where they live close enough so that the kids continue to go to the same school. So the parents have to live close enough together.

Well, you can see the answers above. All correct. I have a question for you though. Not ill intentioned by any means, but just to provoke some thought.

What is more important to you; your job, your house, your friends, your travel time, or your child?


If it were me I would never be more than an hour from my kids if they were taken from me. That's just me though.

When I was typing custody papers for family court many of the papers said (for the parents living in different states) the parent with primary custody got the child(ren) during school term and the other parent got the child(ren) during summer vacation.
