| If you have any type of visitation order set through the courts, you have to get the biofathers consent first, before moving even out of state with his children. |

| What does the custody/visitation order stipulate? Unless you've been specifically ordered not to (for the sake of the father's visitation), then you can go. However, you may have to return to court if the father decides to pursue visitation. HE may also go to court and try to specifically prevent you from moving. |

Even though there's been NO court action so far, IF the answer to any of Scott's questions is YES, then the children’s dad CAN stop you. No, you won't be charged with kidnapping, but you'll be prevented from moving, or you'll have to move back.
