Husband wants to adopt son.

My husband is not my son bio father. His fathers name is not on the birth cert or any other legal outstanding document. We had arranged child support personally, he has since stoped providing that (which is ok). He has proven that he doesn't want anything to do with him. My husband and I just got married. He wants to adopt him but we are unsure of the steps to take in order to do that. Any Suggestions is greatly appriciated. My son was born in CA and we now live in CO if that matters. thanks!

I am pretty sure that the bio father has to sign off on his rights first. If he wont I think there are steps you can take to terminate his rights. Well thats all I know about that subject. Good luck and congrats on your marriage!

I could have sworn I answered but my post isn't here. Odd

You need to hire an attorney who will notify the bio-father of your intent and try to get him to formally relinquish rights voluntarily. Once rights are relinquished your husband can then file a petition to adopt.
