Husband moving out

I'm not quite sure what do do. My husband has decided that he needs his "freedom" and his "space". He wants to move out and live on his own and I suspect it is to carry on an affair with a coworker (I have evidence). We live in NJ and have a 9 year old son. I want to work out our problems but he refuses to see a marriage counselor. Because I do not know what state of mind he is in I have transferred out all of our savings into my account. I want to save our marriage but I also don't want any more of that rug pulled from under me. I am at wits end -- should I file for separation, and how should we deal with the financial aspects. He pays part of the bills. Also because of other problems the 2 cars are in my name as well as the insurance (one car is paid for the other he still pays even though in my name). He is moving out this Sunday after we talk to our son.

Hi, toothpain,
I am so sorry to read this. I am 64 yrs old, Divorced after 7 yrs of marriage; then re-married now for 29 yrs.
I am not a Lawyer, nor a professional; just someone who has been through this.
First, you NEED a lawyer; not the same one your husband might be thinking of getting! You need one to look out for your interests, advise you professionally on what to do, and file either seperation or divorce papers for you, and to work out child support payments, as well as visitation rights.
There is SO much, that getting a Lawyer will help you decide what to do.
It will be well worth the cost, but ask what the cost will be.

valinors_sorrow agrees: Great advice! Get a laywer right away for some (hopefully unnecessary) financial protection for you and your child - at the very least, that car situation sounds hazardous to you
