    There is no set age. Its up to the judge to decide not the child. There may be some consideration depending on age but its still what's best for the child as what is considered.

    A child cannot decide. That decision can only be made by a judge. Some states have guidelines on how much weight to put on the child's preference.

    ANY question on law needs to include your general locale as laws vary.

    Generally, the NCP has to go to court and file for a modification of the custody order.

    The child can decide what they want to do and make their own choice when they are 18 and can just move where they want.

    Before that, the courts may allow them to give their opinion in court at 12 or above ( each judge will have his or her own views on the age) But the parent the child is not living with, will have to file a motion in court and sue for a change of custody, The judge and court will view all info, needs of child, what may be best for child and other factors.

    At 17 they have less than a year to go before they can decide on their own. It might take that long to go through the courts.
