How can I get my sister to get custody over me?
I am very unhappy and stressed in my home. I hate it here. My dad is yelling at me almost daily, I have been grounded for five months because of a boy, and I feel like my dad is mentally and emotionally abusing me. People argue with that, but I feel attack emotionally. I don't have a mom, she passed when I was 10. My sister is 22, engaged with a baby who is a month old. She doesn't have a lot of money, she is virtually broke with the occasional boost in funds. My friend brought up a custody change with my dad to my sister. She said me turning 15, I had a choice. I want to know EVERYTHING about it. Ins and outs, ups and downs. I was thinking about my friends parents get custody over me as well. I don't know if it is possible, but I am desperate. I also wanted to know some things about emancipation. I know that you have to have a job and only about 20% of cases get cleared. But I really just want out. Please let me know everything you all have on your mind. Thank you very much.

Any question on law needs to include your general local as laws vary by area.

Generally, at 15, courts will listen to your preferences on custodians, but the courts will make the decision, not you. To effect a change in custody, your sister (or whomever) would have to petition the local court to become your guardian/custodian.

As for emancipation, generally, where emancipation is allowed, you have to prove to the court that you can live entirely on your own. Support yourself etc.

If your sister hires an attorney and files in court and can prove that your home life is not good, and at 15 you can tell the court what you want, but you have no "choice" the court can and will decide.

Tell us more about the "boy" and what was happening to cause you to be grounded. So at 14 or just 15 you had some issue with the boy, your dad wants to protect you.

Please give details of why home life is bad except that you don't like to have protective rules

I also want to add that a 22 year old who is "virtually broke" and pregnant is not likely to be considered suitable to have custody.
