he wants to sign over his rights

I have a 3 year old son who knows my fiance as daddy and has for a year. his biological father has never wanted anything to do with him, wasn't there for the birth or birthdays, and has decided to not pay child support anymore, the only way he can do that is to sign over his rights. He gave me his word that he would. I want this so bad, for one main reason, if anything happens to me, my son, Adam, goes to his biological father, Jerry. A man who is in and out of prison, who is abusive, mentally physically and sexually, and does not even like my son. I want to persue this now that he is willing, but would like to be able to do it without a lawyer, i don't have the money. How can I?

it is really hard my son and daughter in law are getting divorced and she wasnt my son to sign off his right s his legal . he has two daughters and he will take his son with him she does not want the son so what is a person to do i think this is all a terrible thing just no child support and leave him alone he may straighten out his life and the child will have a choice when he gets older and this is really hard on other grand parent I will never see my granddaughters ever again now who is this really hurting the grandma I cut there cord after birth and had them all the time weeks on in while they were out on vac. I just think you are hurting the children by using the bio dad a leverage he will straighten out and the child will have a choice to where he wants to live i hope this helps understand the other side of it

The only way he is not going to have to pay child support is to sign over his rights and allow your fiance to adopt the child.

Merely signing over his rights does not take away his resonsiblity to pay.

And I am going to sound really meam. But you were with him, you sleep with him and had his baby, if he was a crazy excon now he was then also.
So you did not have a trouble sleeping with him but now he is not fit,
Really a bad time to think of it.
