I've been divorced since 2001. In 2003 I was living in CA, my ex was had visitations on Wed & every other weekend. Child support at that time $1,300/mo. for three kids. During that time I was driving 2 hours a day to & from work when the opportunity came from my employer to move to Las Vegas - I was able to purchase a 4 bedroom house and paying only $300 more then the 2 bedroom apartment I was living at. Long story short I was granted permission to move to L.V. then at that time somehow my ex no longer worked and started his own company therefore was only able to pay $700/mo. for child support.

To present time - since moving in Dec of 2004 I have only missed 3 weekends (1-work related, 2-kid activities) My ex has taken me to court 4-5 times 3 of those "emergency hearings". He refused to come to Las Vegas. Our original agreement was I went to L.A. one weekend and he come to L.V. another weekend, however to stop the arguments I settled in 1 weekend I drive to L.A. and another weekend I fly the kids out & he flies them back. After almost 3 year it's taken a fianacial harship and I can no longer afford this.

Now, to make this very clear I have offered on many occassions for my ex to visit the kids and he refuses. We've been in court because he wants less time with the kids... yet he continues to threaten to go back to court and financially hurt me and he is doing it. I'm drowing... His summers - I've offered for him to keep them the entire summer or 1/2 and he refuses all he wants is 2 weeks w/ all three and 1 week individual after that... this is after he originally had them for three weeks. He refuses more time but complains that he wants to see the kids (on his terms).

I've moved away to give the kids a better live. They are happy and love having their house. My ex lives in a 1 bedroom small trailer... this is the same man I told he could keep our house. My kids are now (after almost 3-years) joining sports and practices/games will be on weekends and he is upset - again, I've giving him open inviatation to visit and he refuses.

I am NOT keepeing him away from his kids but he wants ME to spend all the money and effort because I choose to move. What rights do I have?

HELP!!!

P.S. Since my move to Las Vegas (Dec. 2004) I've been back to court 3 times (on "emergency") plus 1 I missed because I was given a day notice.

My guess is that this has had no answers because it sounds pretty complicated. I don't quite understand why you were taken to court on "emergency hearings" or what exactly is being fought for? He wants LESS time with the kids and you don't want that? You say that "he has an open invitation to visit", does that mean him come to you? No matter how generous that is of you...the court won't really look favorably upon that. The court will see it in the fact that he has the right to have the kids with him at his residence, they won't expect him to go to the kids. The fact that the kids are getting older and becoming involved in sports and other extra curricular activities is great and will be considered beneficial to the kids by the court but you really need to revisit the entire custody schedule to accommodate for those activities.

So, I hate to say this but the bottom line is you will really need to check with a lawyer to find out what your rights are exactly, especially since it is an "interstate case".

You give us lots of info, but not the info we need. What was the results of these emergency hearings? What were the grounds for them. What it sounds like you need is petition the court to get the visitation modified.
