going out of state with no permission

Me and my boyfriend are split up and have a child together but we have not yet started custody and support and all of that so between that can he take our son out of state with out my permission?

Is he the recognized father - birth certificate, DNA testing?

yes he is his father he is on the birth certificate and we live in NY i dont know if the laws are different

yes, until there is a child custody order in place both parents may have the child and travel as they wish, if both are on the birth certificate

Until you go to court and the judge orders otherwise he has as much right to travel with the child as you do. After the judge orders the visitation then it will be spelled out when he can have the child but even then the ncp will generally be able to do whatever they want as far as travel while they have the child they just can't take the time away from you to take the child on a trip.
