child support

My ex and I have a child support agreement of $120 a week for our daughter. I set up a trip for my daughter to visit with my parents for a month in florida. ( i reside in new york) He stated that while our daughter was away with my parents that he is not going to be paying child support. The child support obviuosly never goes into my childs pocket because she is seven. It goes right into the bank for bills. Legally, shouldnt he still have to pay child support because the money is to keep a roof over her head and what not? Please let me know as soon as possible. Thank you

I'm not a lawyer, but what your ex is doing sounds like bs to me. I'm a divorced mom, too- if he is going to invent his own rules, I would see if you can have his wages garnished instead of relying on his mood or what conditions he considers support-worthy. The money is supposed to be spent at your discretion, and your daughter still needs a home with lights, groceries, etc. to come back to!

Is your support court ordered or just by mutual agreement?

I would go back to him and tell, him, if he wants, he can send the check for that month to your parents. But he still owes the support.

If it is just an agreement then he dosen't have to do anything. If it is court ordered then he has to go by what the court has ordered.
