Florida Dead beat shared custody parent

Asked Feb 5, 2011, 03:17 PM — 2 Answers
Florida non-cos parent hasn't seen child in over 4 years and hasn't paid court ordered support in over a year. Is that considered abandonment and can I get sole custody. The court says that he can claim child every other year. The IRS says that non cost parent must provide at least 6 months of support for the child. Child Support Enforcement is a JOKE in Florida. Please help. I need some advice. I can't take on a third job, I hardly see my child now. Thanks

What do you think sole custody will get you? If you feel that he shouldn't be entitled to claim the child, then you go back to the court and ask for a modification of the order.

You most likely have Sole custody, that is where you have full legal and physical custody and the other party only has visitation. Sole custody does not mean the other party does not have visits.

What you want is to take their rights away, normally it is not going to happen, unless you have a new husband that wishes to adopt.

You may go back to court and lower his visits, or even stop them for now, unless he comes back to try and establish them again.

If he works do you have a garnishment of his pay ?
