    fathers rights if not on birth certificate
    I am my child's father but the hospital refused to put me on the birth certificate due to us not being married. Now my x has recently moved out of state even though I have been involved in my sons life since he was conceived and supported both him and the mother. What do I have to do to get my son back as fast as I can

    Did you go to court for joint custody and visitation after the child was born? Did she file against you for child support?

    ANY question on law needs to include your general locale as laws vary by area.

    The hospital was correct in not putting you on the birth certificate without the mother[s permission. But they should have informed you about signing an affidavits of paternity. In any case, you NEED to go to court to establish paternity and your rights. Not doing so was foolish and allowed the mother to move away from you. So I would go to court today to find out how to file, or better yet, retain a Family Law attorney today to protect your rights.

    Until you can be declared the legal father you have no rights.
