Is this enough evidence for infidelity?

I have found a stained tshirt from another man in my wife's car. is this enough proof in court for infidelity?

how do you know what the stain is? you better be right if you are going to accuse her.

No proof of infidelity is needed. You go to court and file for divorce.

Why are you trying to prove infidelity? If it is proof enough for you to end your marriage, that is all that matters.

Jesushelper - you disagree on what grounds? On a legal ground, no proof of anything is needed. Divorce is based on irreconcilable differences. Proof of infidelity only matters if you live in 1963.

On the grounds that the T shirt does not prove anything really. There could be an explanation for the T shirt and he should look for more clues before he goes throwing away his marriage.
So sure if he is wanting out of the relationship all he has to do is file for divorce without proof. If he is wanting to know if the T shirt itself proves infidelity then I would go with looking for more clues before taking a drastic step.

The question was "proof enough in court". It made no reference to whether it was infidelity - it was about the legal proceeding of divorce.

Yeah the way he worded it sounds like he is looking for an out to his marriage as you said he does not need.
I was just saying that that is the way I think Jesus Helper was meaning what he said.

I took the facts that a)the OP posted on the "Divorce" board and b)he's asking if the shirt can be "proof in court" to mean that he had already started divorce proceedings.

Whether that's true or not, the OP doesn't seem to trust his wife and is looking for validation - kind of a "see, I knew it" type of thing.

Steve is right. This question is nonsensical on the divorce board. Courts don't even allow evidence of infidelity-- this OP thinks and assumes they not only allow but expect it.

This thread should be on the relationship board under, "Should I leave my marriage?" or some similar topic.

The reason i ask is because the night before she was found by the police parked with another man. The man took off and the police never wrote a report but impounded the car and made me pick her up. They had found drug paraphernalia in the car but didnt charge her or even write a report. Further proves the police are WORTHLESS unless their writing speeding tickets....as to my original question, can someone PLEASE just answer it instead of judging me!! Would it stand up in court due to the fact the shirt is not mine, smeared with , and obviously belonged to the man who jumped out the car
