adoption

My daughters Father has not been in her life at all.He was not even there during my Pregnacy. He was nopt there for the birth of my daughter. My daughter is a sick child with medical needs. She has had aprox 19 surgerys. He does not pay child support unless his Mother pays. He was court ordered but does not follow the order.I 'll get a check maybe 1 every 8 weeks. I want to know how do I take his Parental rights away. He has maybe seen her 4 times in her life.I want to know because my Husband wants to adopt her.

First its not a good idea to piggyback your question on someone elses. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Also please do not post the same question in multiple places. Your other post have been removed.

I would be more inclined to force him to pay the arrears. Expecially since you can't take his rights away. He might be willing to give them up rather then pay child support. So you need to consult an attorney to prepare the adoption papers. The atty will advise you further.

You cannot take his parental rights away, he has to relinquish them voluntarily Unless he does something horrible and the court orders him to stay away, you're not gonna be able to get his rights taken away. You should try to get a lawyer and sue him forthe back child support though. Your husbnad can adopt her if he agrees to give up his rights.

As the others have stated....you can't take away his rights. He would have to willingly relinquish his parental rights to allow your husband to adopt. So I was start with him and see if he would be willing.
