    DNA test proves not the father but signed the birth certificate
    My brother lives in the state of Georgia. 2 1/2 years ago he signed the birth certficate of a little girl that he THOUGHT was his. The mother put him up for child support several months ago and he requested that a DNA test be done... the DNA test shows that he is not the father... how do we go about getting his name off the birth certificate and is there a certain time frame in which this must be done. He is not married to nor has he ever been married to the mother of the child.

    Well number one... make sure that DNA test proving its not his is on record with the court the support order was ordered for. And make sure you have copies in case they are needed in the future. Don't assume anything. And be thankful he isn't in Virginia and hasn't been even just living with her... or he'd be screwed.

    I don't know about the birth certificate end of things... but others that do will be along with that info.

    So if it IS on file with the courts the support order was ordered for is that all that has to be done?

    Not so simple... states vary and some even if its later (after a certain time) proven to not be yours will still order you to pay it. Virginia is like that. I know two guys in jail for refusing to pay support on kids their wives had via adultery that DNA tests have proven they weren't the fathers of.

    The earlier you establish a time and date it was known.. the better off you will be in case of further litigation. I would make sure you have a copy as well for future reference in case she tried to collect from a different venue.

    YOU have to wait for someone more familiar with GA standards and we do have at least on person from Ga that would know.
