    Child Abandonment Laws in Georgia..
    Fairy Tale Beginning...

    I moved in with a family to be their nanny. Fell in love with the boy that I take care of. Then fell in love with his father.

    But his father still isn't divorced...

    My boyfriend's wife won't sign the divorce papers because she doesn't understand that there can not be two legal primary parents unless they live in the same county or something. She lives 2 hours away so that can't be done.

    The only time she ever asks for her son is when she wants to keep him then ask us for money to take care of him while he's down there.

    Last two times he's gone to her house he got pneumonia and had three ticks on him.

    She didn't see him for a whole month afterward.

    Is there anyway we can file for child abandonment in Georgia, since she doesn't see him regularly, does not help with child support, and doesn't give us food for him?

    For one thing they are still married. He would need to start some sort of filing first. But from the sounds of it there is no abandonment yet. And since they are married then there is nothing to order from the courts until something is filed.

    He HAS filed for uncontested divorce but she sign the papers now that she's read them. She doesn't understand that she can't be a primary because she lives too far away. And she won't listen to us or our attorney.

    Most states have no fault divorce. If she isn't sgreeing to it then why is he trying to file uncontested? Also HIS lawyer should file an exparte motion for custody and for child support. Why is he sitting on it?

    We tried to file uncontested because she was agreeing in the beginning. Now that its contested I think we have to give the lawyer more money that we don't have.

    First "WE" did not do anything HE filed, but guess what, the divorce is contested, so why has he not filed for a contested ?
    Yes it costs money, most likely they will want at least 3000 to 5000 to just start it.

    Next why has he not filed at least for custody ? And child support ?

    Next in GA, they can have joint custody legal custody, but with living 2 hours apart, then one will have primary physical custody and the other visits.
