Biological father wants to bring police escort to pick up daughter

Asked Mar 23, 2012, 07:32 PM — 2 Answers
I was never married to my daughters father, instead I was split from my husband at time of conception. Illinois law put my husband on her birth certificate and that was fine with both of us. Now my daughters biological father wants a police escort to pick her up in the morning. He isn't on the birth certificate and hasn't had a dna done... Will the police even get involved? And if so, can't I just show them the birth certificate from the hospital with my husbands name on it and there will be nothing he can do? He doesn't deserve to see her. Since we found out last may I was pregnant he refused to help get anything. And since she was born in jan he hasn't done much. And he can't even be responsible enough to hold down a job at mcdonalds. He has bounced around from house to house. He is so financially unstable he can't even get the gas to come see her unless he donates plasma. I don't want him around her anymore. What, if anything, can I do to legally keep her from him?

At this point they will not do anything,

He can file for paternity in court and ask to have the birth certficate corrected. He can file in court and ask for court ordered visitation. He can ask for exchange of the child to happen at the police station ( very common) or fire house ( more common)

so his next move is to file for paternity in court.

Your ex is an idiot of he thinks he's getting that child. The most he can do is take you to court and even if he did have a DNA test done all it would prove is that he was or wasn't the father. And even if he was as long as you have evidence that states he wasn't there and he doesn't have a stable home or job. He might get supervised visits if he's lucky. They won't let the child stay with him if he doesn't have a stable home.
