    I am the primary custody person for my daughter and her father left her home alone
    I have primary full custody and her father sees her everyother weekend. This morning I found out that my daughter was home alone being watched by a 9 year old. My daughter is 7. I happened to call to ask a question this morning and the little girl answered the phone and my daughter got on and told me that her dad and his girlfriend went to work and they were alone. Yes my daughter would call 911 in an emergency but if something really did happen, she would be too scared to think. I think this is irresponsible!! When you call his phone he doesn't answer and his girlfriend doesn't answer her phone. Yes there is a neighbor across the street but it is a busy street and hard to see cars coming and they would have to cross it. My daughter's father has his girlfriend pick my daughter up at the door while her father sits in the car, I don't want to let her go with his girlfriend but I am afraid that he will get me in trouble if I don't let my daughter go. He has had 2 DUI's before, He has been in jail for up to 2 years, my daughter had come home dirty and gotten yeast inections from not being cleaned at her father's. But my daughter loves her father and I don't want to take that away. I never thought he would test the welfare of our child. Is there any advice from anyone? ALso, I was going to take him back to court but I didn't take parent classes that was in my custody order but neither did he. If I try to re do my court order do you think that I will get into trouble for not attending those classes? It has been 7 years that we have had the same custody order now.

    What would I do if I found that my 7 year old had a 9 year old babysitter?

    My first call would be to the Police. My second call would be to my Attorney. If I didn't have an Attorney I would be at the doors to the Courthouse when they opened on Monday and I would ask for a change in your visitation (and perhaps) custody order.

    This is dangerous behavior. I'm sure you realize it was irresponsible for you not to take the Court-ordered parenting classes. However, a fear of what will happen if you go back to Court should not keep you from protecting your daughter now. Her father is irresponsible.

    You won't renew your Court order. You'll get a new one.

    She came home with a yeast infection? What does the Doctor say about that?

    I would be calling the Police now.

    Thank you for the support! Well the yeast infections were in the past and I actually called child services and they said that it was not neglect nor abuse. That is when she would come home in a soiled diaper and then the same underwear

    The cop met me at the house but he told me that it is a civil case and it goes by how they think the child would handle an emergency. He could not arrest her father or press charges. I do not have a lawyer but I am going to call the case worker.

    Where the heck is this? The Police didn't think there was a problem with a 9 year old babysitting a 7 year old? Not in NY, I can guarantee that.
