2 people to testify for my being better, emproving my life ,etc.<br />
and some letters from people who can't be there with a good excuse not to be<br />
i'm also going to start n/a today until out-patent treatment starts<br />
i will get that documented<br />
my question is <br />
what are my chances that they will not lock me up on the fourth?</div>

			<content:encoded><![CDATA[<div>I have been my worst enemy.  I thought I could believe what was told me and talk to the police and everything would be taken care of.  My employer went into the hospital, his daughter in law spoke with me, stateing that my employer was dying, this of course upset me and I assumed from the conversation and her telling the safe was open, not to worry about being paid that i was to get my pay and her husband would be over to close up.  I cleaned as instructed and waited.  It got late so I went home.  Her husband showed up hours later and let me know his dad was still alive.  We cried and hugged and he left.  When my employer returned home I tried to bring the matter up and he stated he was not up to it. At this time I only had 3 weeks of employment left(He was going to rest home because of pain meds and health problems)  and to wait until then when he was stronger.  I agreed of course.  Son and wife went to Mexico, other daughter came to visit, he had  other company too during my last month of employment.  No problems were ever mentioned. Then on the 28th the d-i-law called me accusing me of taking money, more than than wages-500.00 and jewelery too.  I asked to speak with my employer and she refused.  The next day he called and asked me to come and work on monday and we would discuss the matter.  I took the blame-did not want to upset him any further by telling all the mean things the d-i-law had said up to telling to get my pay.  He asked for me to put in writing what happened and aplologize.  I did  so as he mentioned his insurance and the police! Then the police called me and I still thought I could clear this up by telling the truth.  Was charged with stealing 8,000.00 and jewelery.  I told them most of what happened, was asked to take a lie detector test, said yes (never happened), no one came and searched my home.  Now I'm have charges and court.  The paperwork says the money was taken between dec 2008 to march 2009.  The d-i-law denies even talking to me on the night in question.  My court appt attorney has not done much, to date I have not actually met him-I've been calling in as ordered-and have spoke with him 2 times, I have court (3 time) pretrial I believe, with real court on dec 15.  How can this happen.  I am willing to take the blame for my stupidity and for the money I took, but the rest is not true.  What can/should I do?</div>

What's the likelihood that a first time offender, charged with third degree assault, would lose a top secret security clearance? And, under what conditions? Can I report this - and other unusual behavior - or does the govt just have to &quot;discover&quot; it? Question relates to a neighbor who physically assaulted my husband and claims to have a top security clearance and be worried about his job.</div>

			<content:encoded><![CDATA[<div>Unfortunately, this situation has arisen in FL. I honestly believe this young man may have finally learned a lesson...<br />
<br />
The young man in question was placed on felony probation in 2004 on four charges for 10 years, sentences run concurrent.<br />
He was re-arrested in 2005, but the charges were nolle prossed and probation re-instated.<br />
Re-arrested in 2006, sat for 2.5 yrs in the county jail before going pro-se and having his dispositive motion to suppress granted. The State appealed and it has been in the appellate court for almost a year, all the briefs submitted about 3 months ago. He was transported to the court where he was put on probation and given a hefty bond. He was bonded out and continued to show up for VOP case management hearings. <br />
Four months after bonding out and before his VOP was resolved, he was re-arrested. He sat for 6 months then accepted a felony plea. He will have both new law and technical violation as he was out of the county. He was then taken for first appearances and they gave him another bond, still hefty but this time a little less.<br />
<br />
My questions are:<br />
1. Can he be violated again for the new plea acceptance since he already had an open violation case?<br />
2. Typically how long does it take for a violation of probation hearing? Are there any statutory guidelines? <br />
3. He says his case fell under the old guidelines when score sheets were used, so will he be sentenced accordingly or can they take all the time he has served and give him ten years in DOC?<br />
4.Is it likely they will re-instate his bond or does his history look too bad for that? What can he do to improve his chances? <br />
5. How long does the appellate process typically take?<br />
6. Can they conduct a VOP hearing with one of his VOP cases still being in the appellate court?<br />

A month after he quit, a prospective employer ran a background check and there were no warrants on his record then.<br />

My question is two fold. <br />
<br />
1) How do I (we) check to see if there really is a warrant out for his arrest? Do we call the local police for his place of business, the county sheriff, or the magistrate's office?<br />
<br />
2) What is the law regarding what exactly a former employer may tell a prospective employer during a reference check?<br />
<br />
We need a quick answer to both questions because he has been trying for 3 months to get a new job and can't. He had one almost wrapped up when they ran the background check and checked his references and suddenly withdrew their offer of employment. We suspect it is his former employer at work again. We did ask them why they chose not to offer employment but never got an answer back. The people who ran the background check even told my husband that he has an excellent background!</div>
