			<content:encoded><![CDATA[<div>hi i work as chef and since we got a new manager he has started taking hours off of us that we have worked to lower his wage percentage. last week he took 2 hours each off of 4 of the full time staff and when asked he had excuses that he hadn't added the hours up right or he forgot to add parts of shifts on and for the members of staff that smoke he says that they will have been for a cigarette so he is taking 15 minutes off of them for that break, he used this excuse for me when i had been on a 5 and a half hour shift because he wouldn't believe me that i hadn't had a cigarette break because it was busy, because he said smokers can't last that long without a break when he knows that i can go without a cigarette if its too busy. i don't believe that its right for him to keep taking hours off of us that we've worked for no reason can someone tell me if this is allowed or not.</div>

			<content:encoded><![CDATA[<div>I work part-time at a publication in the production department, but have been offered the chance to write articles for various editorial departments, the editors of which have also offered to pay me for my work out of their freelance budgets. My boss in production says I'm not allowed to do that because then I'd receive both a W-2 and a 1099 form, which she said would be illegal. I offered to do the writing work for free on my own time, because I'm just starting out, and anxious to build my portfolio. She said that was also forbidden, because working for free when not on the clock would make me a liability. She said that I was hired as a part-time production assistant, and that was the only job I was allowed to do.<br />
<br />
I wanted to know if this info is correct, at least re: the tax issue of W2 and 1099 at same job. I'm in California, by the way, in case that helps.<br />

I appreciate any assistance with this matter.<br />
