I need some desperate help because my two children ages 15, 13 are temporarily with their father because the Texas courts awarded him with the kids due to earning more money than mom because she is fully disabled but still able to fully take care of kids. Father verbally abuses them esp. 15 yr daughter, doesn't take care of them or their medical or school needs, contributes to their truancy for school, and verbally abuses mother, and lies to the courts and attorney all the time. He won't allow me to be in the kid's lives, won't let me take them to the doctor when they are sick, kid's constantly call and email their ad litem attorney that I paid $1,500 as ordered by the court but she refuses to do anything to help them. The children (both) signed letters of preference to be with mother yet court and judge completely ignored this, refused to give much needed spousal support due to having 23 surgeries due to an 18 wheeler accident over 8 years ago, and even though I paid for family home with own money I was kicked out of it only after 2 days after 1'st temp orders trial, without out being able to take anything but dog, paid van, and half my clothes even though I paid for everything with my money and all all receipts and proof. I am being forced to pay child support of $200 a month even though I only earn $1,200 from disability check and due to having to pay rent, own utility bills, gas, medical insurance, many medical bills and medications, etc. I don't have enough to pay for child support when ex husband makes $5,000/mth. Now because I haven't paid him $1,300 over 8 months, (I did give him a little bit of money) I am being threatened to be put in jail for over 4 years, pay large fines, and be put on probation for 10 years after be released out of jail. This is all being done by him and his attorney. My 2nd paid attorney refuses to do anything even though I have paid her a lot of money over $5,000, she refuses to file any motions, makes decisions without consulting with me first, and always accuses me of lying even though I gave her all the evidence to prove I am telling the truth, pictures, videos, recording tapes, email, bills. I am desperate as I don't know what to do anymore and my children hate their dad due to the verbal abuse and constant neglect, and lack of love.. What can I do to stay out of jail due to not being able to pay child support even though I already provided all financial statements to demonstrate all income and payments each month? What can I do to help my children when the judge refuses to talk to them even though I already filed a motion for judge to confer with the children 3 times but judges refuses to speak to them or sign or acknowledge motion? Children's paid ad litem attorney refuses to help kids and ignores their emails and phone calls, and doesn't come out to see them? Kid's doctor and psychiatrist is really worried about them and don't believe that they should be with father as he is the one who caused divorce due to constant verbal abuse, ignoring and mistreating entire family, refusing to pay bills, moving out of bedroom (separated for over 3 years). I have everything to prove my case including the stupid mistakes he made over the years, comments (verbal abuse towards entire family for many years), and admission that he physically abused kids when younger and subscribed and viewed porn at family home and computer, he also allowed my daughter to speak and email older men and he even took her to see older men at parties while being the only girl there with 6 guys ranging from 30yrs and up and him not knowing 3 of them (3 where co-workers or friends other three they met on internet and don't know if they have criminal past or are child molesters or rapists, etc.) from court transcripts. Does anyone know how to file a reconsideration for spousal support motion in Texas, as I need this money and under Texas law I qualify for this money? Does anyone know how I can help my very sad and confused children and how to get them out of the situation they are in since attorney, judge, CPS, and police refuse to help? Please help as I am near the end with no results, no help, and the inability to help my depressed and beautiful children! I am out of money and justice is definitely not prevailing for me or my children. I was not ever proven unfit, don't drink or do drugs, don't hit or yell at children, do even go out, all I ever did was go to physical therapy, take care of my children and their school and health needs, and went to college online in order to always be there for my children. I had 6 witnesses to prove I am great mother and have raised and cared for many other children of family and friends. He only had 2 witnesses (his brothers) and they couldn't say anything bad about me either as I raised their children as well. Therefore, I was proven to be a great mother regardless that I am disabled, paid all the home bills (before being kicked out) (I was even ordered not to take the utilities off from my name in home I am not even living in and he has ruined my credit by not paying them on time or in full. I am so lost and depressed please, please someone help!
