I need to sell the house

I asked my husband for a divorce a few months ago. I have no problem with the fact that he wants to keep the house, in fact I am willing to give it to him just to be able to get out of this marriage. The problem is that I know he will let the payments slack and loose the house to foreclosure. Can I legally list our house without his permission? I can't afford to have any more ruined credit.

Welcome to AMHD. Is he an owner of the house? If so, I doubt a realtor would list without his name on the contract.

If he is going to let it go into foreclosure, then why wouldn't he agree with you to sell it so you both benefit from the sell? My soon to be ex also wanted to keep the house with the agreement that when the market gets better in our area, he will buy me out. I know this may be months or years from now, but we had it written in the divorce papers. I don't think you can list it without his permission, call a realtor in your area, they should be able to answer that accurately for you. I wish you the best.
