    When does a detainer get lifted
    Hi my boyfriend got aressted on a probation violation and he went to court and everything was dropped.. but my aunt said that he would have to wait till a judge signs this off so he can get out... can any one tell me how this works ? I would really appericate it.. thank you so much... and that the judge would probably make him wait at least 3 months before he gets out... thank you if you could help me out it would be very help ful... lawinone

    It sounds like he was arrested on some new charge, which was droped but becaue he wa on probation, the put a detainer on him?

    In those cases yes he still has to have a probation hearing, and they will or could review the evidence from the original charge, Probation has tighter rules and merely being invovled, with certain people and things can get your probation revolked.

    He needs an attorney,

    In my area (NY) YOU fill out the necessary paperwork and go before a Judge. Where are you?

    Is the probation oficer the only way to get a detainer lifted?If no who else can do it?

    No, the PO can not do it, once it is put into place. Only the judge can.

    Hello j:

    No. A detainer is a hold on a prisoner from another jurisdiction. The prosecutor in THAT jurisdiction can drop the detainer.

    Yes, but sometimes it is best if you go threw the main judge that sentenced the probation. In some cases they are more understanding than a probation officer.

    The judge that gave that person the probation can lift a detainer..

    You HAVE to go to the Judge. A PO CANNOT lift the detainer.
