I have a dear friend that has a warrant out of California for a violation of probation , on a domestic violence case...

Our Question is simply this, if she turns herself in "out of state" and California chooses not to extradite her at that time... does that warrant have to go away sense they had the chance to settle the case and chose not to... she would be turning herself in for that specific purpose... any help on this would be greatly appreciated.

No, that warrant stays active till they finally take her back, catch her closer or decide to finally turn her self in there.

What happens if she was actually stopped, lets say for a traffic ticket, she would be handcuffed and put in the back of the police car, and they would wait normally for up to 45 min ( 30 min in some states) to see if California will answer them back as if they want this person. Normally it takes about 15 to 20 min to get a result. If they want her, they will be taken to jail, and asked to sign consent to go back. Or she can fight going back in court ( almost always loses but right to fight)

If they do not want her, they release her but the warrant is still active and she can be held again each and every time she is found.

I know that if you get picked up in one county and have a warrant in another county, same state and the county you have the warrant out of dose not come and get you within approximatly 5 days they then have to drop the charge they had on you. However the catch is YOU MUST make a court date to appear in front of the judge in the same county the warrants in to show that they choose not to get you therefore the charges are dropped. Until you go to court the warrant will still be in affect even when you are released, they just don't tell you what you need to do. That's how it works in calif. Anyway.
