Plea Agreement

I have not had an indictment it has been over 6 months. I want to go ahead and plea this out to felony probation. I have not had any prior felonys but I have had misdemeanors. I have been on misdemeanor probation and revoked it but sat my time out in jail. If the DA accepts a probation plea agreement and I take it before the judge and The JUDGE does not agree with this agreement (i know its rare) does he/she change the sentence right then or Can I take it all back and keep doing as I was doing? Is it even possible to get felony probation after revoking a misdeameanor probation but with no felony charges except this one? This is In Texas.

Hello lil:

If the judge doesn't accept your plea agreement, then you go back to square one. He does NOT change things right there.

Is it possible to get felony probation????? I dunno, dude. There's a jillion factors that go into it. There's no way we could tell you that.
