Nassau county probation stipulations to get license back?

Was the interlock system ordered for the same time frame as probation OR for another time frame?

In NY they are being ordered both ways. I've seen 6 months probation and 3 years of interlock.

Hi Judy, There was a stipulation for when I was on probation that I must drive with an interlock! I was even granted a license after 6 months on probation with the lock, but I hated it so much, my car kept stalling in traffic, not to mention the expense, that I then turned in my license. My probation period ends next month after being on for 3 years. I'm worried because 20 years ago I had a previous DWI and when I called Albany they said probation has to stipulate I don't need an ignition lock anymore. I have been through 3 PO's, and my most recent probation officer has never even met me. I call in on the phone. I have met all conditions of probation, I was in a certified weekly program for a year, and I haven't been in any trouble. I tried to call my PO, but she is on vacation for the next 2 weeks. My life has become so dependent on others driving me around, I have so learned my lesson, and just want my license back, but w/out the lock! Thanks for your quick response!

If probation specifically says "while on probation" and you are no longer on probation you should be able to get your license without the Interlock device. I see no legal reason to deny you. However, DMV could very well dance you around until you either get the Interlock or retain an Attorney.

Interesting side note - in my area the Police did a demonstration of how the system works. THEY couldn't get the car started! I don't know if the system was too sensitive - or what the sensitivity was! - but it was, umm, an interesting demonstration.

No, no specific firm. I would look for someone who specializes in criminal law, advertises they represent in DUI and DWI cases.

I'm going to look up the law again this afternoon so I'll be back. I have no reason to doubt what I've posted before but I like to double check.

(It seems that everyone who posts about DUI/DWI gets terribly defensive. You have not. I would say that means you've learned a lesson. Good for you! And I really mean it.)

I'm sorry to seem so obsessed with this, but I actually drove with the interlock for just two days, and I almost got killed. My car stalled in traffic with the horn blowing and the lights going on and off, and cars swerving around me. I had to laugh when you talked of the demo with the police, 3 officers showed up when I was stuck and they were blowing into the interlock, and couldn't get the car to go. As I joke, I said I hope no one has been drinking! They had to push the car to the side of the road and I had to have it towed!

I know I did wrong, but I feel 3 years of not driving has taught me a lesson, ( other than the 2 days with the lock) and I'm just scared that a PO who has never met me is liable to make a judgement that can effect my whole future. When I went to DMV they said it's strictly up to the PO, regardless of what a judge stipulated!

While the climate in Nassau county is very hard on DUIs. I believe once you have completed your probation you should get your license back. I would contact the DA's office directly rather than going through your PO to get a definitive answer.
