inmate goes off agenda from prerelease center gets caught 12 hrs later is that escape

If an inmate is in pre release and goes off agenda and is caught 12 hours later would that be escape? or is it not escape until its 24 hours? I live in montana

You don't need to be coy here. Nobody knows you.. I have NO IDEA what going off agenda means... It could mean he killed somebody, or got on a plane to Paris... The time he was "off" has nothing to do with it.. It's what he was DOING while he was off, or the simply the fact that he WAS off that's going to be his problem.

They'll probably send him back to finish his time in the slam. Will they charge him with escape?? Not enough information for me to determine.

the key word here is "caught" is is not "CAUGHT" unless they put a warrant out for him or the department of correction declared him to be missing.

It is very very likely he will be charged with escape. They don't have to, but they can.
