    Indiana Laws on How long a inmate may stay in jail?
    I'm working on a paper for school and I need to know how long an inmate can stay in jail? How long before a trial or an agreement is met? How long after sentencing can an inmate stay? I've heard two years before a judge has to make special arrangements. Is this true?

    Hello j:

    No.

    After an arrest, the prosecutor has 72 hours to charge the inmate or he must be set free. IF charges have been levied, they must try the inmate within 70 days. If convicted, an inmate will stay in jail for as long as his sentence is.. If found not guilty, he's released IMMEDIATELY.

    I suggest that your paper discuss the constitutional right to a "speedy trial". There is one in the federal constitution, I believe it's applicable to the states such as Indiana because of the Fourteenth Amendment, and you should also disuss whatever Indiana's constitution says about the right to a speedy trial. Since it's your homework, I will let you look that up.

    I expect what excon says is correct in Indiana. But you should cite a source or two.
