    My first offender's pardon
    Two years ago I plead guilty in order to receive deferred adjudication and would'nt be charged with the felony. Upon completion I received a First offender's Pardon, but the felony is evidently still on my record as told by employers. Why is this?

    There are numerous non-governmental companies conducting criminal background checks for employers. Regardless of disposition, a record of your arrest will be on file either at a state or national level. The most notorious is the FBI's NCIC system. The NCIC, commonly used when applying for higher risk positions, or obtaining licensing, contains records of all arrests, but not dispositions. Each state has specific guidelines as to whether an "arrest" as opposed to a "conviction" can be used as a determining factor in employment. Even in cases of sealed or expunged records, arrests records are not removed from the NCIC database. Remember, honesty is the best policy... good luck!:)

    A pardon is not the same as having the case dismissed after certain adudication. For example in our state, the judge suspends the case pending completion and after it is completed, the court dismisses the charges, so no conviction at all.

    Butin your case there was a conviction and then a pardon, so the conviction then the pardon will show up, asking for it to be explunged from your record would be the best at this point.

    But even then, as Fastfun said, the NCIC report always has all the records, even ecplunged. But to the public only parts of the total report is shown. But to the police and to national security positions, even explunged records are reviewed.

    Also there are private reporting companies, they review court files and records and keep a file on you, these are not government files, but private records. They often will show all sorts of things you official government record would not show.

    Okay this is my first time trying to get my first offenders pardon what do I need to do I have no clue
