Driving with a suspended license but didn't know
    Hi,

I had an unpaid photo radar ticket, I missed my court date (I had 4 deaths in my family and had a very sick 1 year old, and was sick myself) On my way home from my Dr. I was rear-ended (it was not my fault) and the next thing I knew, the officer gave me a ticket for driving with a suspended license. It had just been suspended 1 week before I got hit, so I never got the notice from the MVD. Anyway, I paid the previous ticket, and got my license back the very next day. Now my court date is set for tomorrow and I have some questions 1) what should I plea in court so that I can explain to the judge what happened? 2) Do you know how many points go on your license for driving with a suspended license? Any advice would be appreciated.

The points depend on the State.

In my area the Judge only wants to know if you were or were not driving on a suspended license - doesn't care why.

You can certainly attempt to explain but I'm not sure the Judge will listen.

Not sure how you could get suspended without any notice. Plead guilty with extenuating circumstances, bring your checkbook.

1.) Unfortunately, you're guilty of driving with a suspended license. You've heard the age-old adage "ignorance is no excuse." That's what you're up against here. Be prepared to pay another fine. You can explain to the judge the particular circumstances but in the end you'll still be convicted.

2.) You'd have to check the motor vehicle code for your particular state to determine how many points driving without a license is. It may even say it on your ticket.
