    Does a criminal record go away?
    My mom was involved in a domestic dispute over 10 years ago, she was charged with assault but they never specified that it was domestic (between her and her boyfriend). Does she need a pardon or does it get cleared after so many years?

    Hi, A criminal record is not erased unless the offence was committed when the person was a young offender at the time. In Canada, I believe you can apply for a pardon after two years for a minor offence and five years for a serious offence. Pardons are given at the discretion of the board and if refused, you have no recourse, so be sure to hire a good lawyer when you apply for the pardon. Laws probably vary in the USA so check the law and procedure for your state. Good luck.

    If for the last 10 years your mom has been clean you go to the county where she was arrested/charged etc and file docs to expunge the offense. Usually if crime is old, and record since is clean, they will review your request, the prosecutors office will determine after it is filed if it can be expunged, (sometimes a judge could be involved too) but you have to file for the expungment (USA)

    I was charged for class B felony possession of narcotics in 1999. I served 6 yrs. Got out on march 7th of 2004 in the state of Indiana. Is it true that my criminal back ground will be cleared after 10 yrs with no other felonies? If so does it start from when I got sentence or from my released date?
