Dishonorable discharge vs. Bad conduct discharge
I am currently waiting a court marial and right now if I plea out the offer is 33 months with a BCD. I could get a lower sentence if I take the DD, is it worth it? I still have to register as a sex offender when I get out. If anyone has any info or knows anyone with a similar case, it would gladly appreicated.

Here's a thought, if you did the crime, why not plead guilty as charged and take what they give you.

If you are not guilty, and I am reasonably sure you would know that, get an attorney that is very familiar with the UCMJ and fight for vindication.

There is a responder here named, "excon," who may have a better perspective than I do.

    Hello s:

Thanks to Don for bringing your post to my attention.

Of course, I don't know the details, so I can only give you a general comment. If you can get less time by accepting the DD instead of a BCD, then I would. I actually don't think a DD is going to serve you WORSE than a BCD would.

I got a bcd from the marines around 2006. The one thing I can tell you is it is damn near impossible to get a job that is really worth a damn. I didn't rob, I didn't rape and I didn't steal. I failed a drug test. Does any one know whether there is a way that due to certain economic downtime and extended time of war you can cut a deal with the gov and serve 4 years in the military and job of their choosing for an honerable discharge. Or the best way to upgrade the discharge?

I got a BCD a while back from the Marines for something that all my peers and lawyers said should have been an NJP- it hasn't stopped me from doing anything I wanted to do besides join the Army. The upgrade process has increased in its likely-hood. I am told 50/50 on it- support yourself by doing community service and staying out of trouble- life isn't over. It is possible to get back in the military- I had a buddy that got a BCD and upgraded to RE3 with a waiver- he is now in the Army- don't give up- BCD IS NOT THAT BAD.

I have also received a BCD from the Marines for so called popping on a piss test but was told this will go away if I reenlist, I tried to fight them and lost I was in 1st Force recon and did 3 tours in Iraq and 1 in Afghan. I had top secrect clearance,I know that the army takes former Marines with DD as long as you didn't rape or kill andybody out side of war. I have never done drugs and never would, I am in the process of getting my discharged up graded and it's a big pain in the ***. But what's funny with my discharge with the corps my reenlist meant code means I qualify for renenlistment back to the Marines and I have checked everywhere and with a BCD nobody can reenlist back to the Marines so you tell me what my discharge meant. I got ****ed over huh?

I got a BCD from a General Court Martial in 1992. I had several State Criminal Checks done and all came back with no violations, misdemeanors or felonies. But on my own I did have an FBI Criminal Check done with fingerprinting and my GCM was on it but it is not classified as a felony, misdemeanor, etc. So unless you have your fingerprints sent to the FBI for a criminal check all should be fine. Also you can go on in life with a BCD is not on any registration site as the sex offender registration will. I would go with the BCD - get something of the less evils out of it. God bless!
