my husband has been charged with domestic violence when in reality it wasn't such a severe situation. It was I who was upset and he called the cops hoping that they would calm me down, instead they arrested us. I refused to say anything but then they said that my husband was accussing me of assault. As i was also upset and angry, i blamed him iin anger. There is no evidence, no pictures, no marks. But ofcourse once in the past about a year ago i had called the cops about a fight between me and him. I know this sounds stupid, but we screwed. Now i dont want him to face the trial. Can i owe up and say i was not thinking straight at that point and accussed him and that he is innocent? Will this help him and well the charges be dropped. Please help. What will the implications of me owing up on me?

charges may not be droped. many states have the right to charge you if they beleive thare was domestic abuse. if you tell them now there was no domestic abuse after your claim there was you can then be charged with filing a false claim.

There has to be some way out.. please someone suggest me how to get out of this stupid situation with minimum damage to either of us. What happens if i don't appear in the court at all

Yep, hire him a good attorney, I was a police officer in GA for some time. and when the rules changed there, we were obligated to arrest someone if there was any sign or evidence at all. If there was someone who made the statement we also arrested.

Without other evidence it may be hard to say, but if he had any marks or signs of being hit , the officers visional statements will be there, like I saw the red marks on his arm or face and so on.

And yes, we still always went to trail, *normally* even if the women said latter it did not happen, the reason why, over 1/2 of abused women the next day will even bail out the abuser, and try to get them out of trouble, so to most, little beleif is given to what they say latter, since we expect them to lie then and try to get them out of trouble, it is the statements when they are mad that are much more beleived by the judges.

also if he did not do "much" but did something, most likely he is guilty so please understand that these are taken much more serious in some courts anyway.
