| | | under process permanent residence application committed offence Hi please if anyone could give me an advice about my case, im hopeless and scared!
I was caught shoplifting in the amount of 64$ at the bay HBC, 2 man approached me and brought me back to the room and search my things, called the police. Police gave me a ticket of Tresspassing to Propety Act (fine of 65$).Police did not arrest me nor bring me to the station. No court date. I paid the ticket soon to toronto Court.
Police said i don't get a criminal record. But i do still have a record? It's minor offence right? Since its minor offence and i payed already will immigration give a fuss on it?
I am applying for my permanent residence and it is on process, will the immigration know about it?
My present open permit will also soon expire and i need to renew.Should i check yes to the question, " have you been convicted of or charged with a crime or offence in any country?"explain. Will they know if i lie?Do they check with the police everytime?
Will it affect my immigration papers and get deported? Will they still grant my PR application?
Please answer....thank you so much!

| If the question is "have you ever been charged with a crime of offense" the answer is "Yes." You were ticketed for trespassing which is a crime. And, no, I don't advise lying on your Immigration paperwork.
And, yes, as far as I know "they" run a Police check. The question is whether this will show up or not.
I have no idea about the deportation and your status - hopefully someone who does will come by. |

Should Immigration Canada check with the Police record everytime you renew for work permit? Since i dont have a criminal record will they find out that i have a minor offence?are they going to check before granting my renewal or granting my PR later? Please help me anybody im so scared.

| This is the second time you posted this - I guess you didn't like my answer the first time? I don't think the Law has changed from the last time I answered you which was about an hour ago.
Should be combined. |

It's hard to get used to the board - take a deep breath and wait. Someone will come along and answer. |

| You're already charged with a crime offense, but it may or may not show up in your record as yet depending on how they update the information.
You need to disclose all information to the immigration, DO NOT LIE.. ever!!
If you're called for an interview, bring an attorney... hope you've learned something. |

| shoplifting, given a tresspass ticket Hi i would like to ask for follow up advice about my case...i was caught shoplifting for about 64$ (my ever first time stupidity, felt so bad and horrible!)and store gave a letter that they will send me a fine or caim for their loses and a prohibited entry of 1 year. Police came and hand me a ticket (Yellow ticket just like a speeding ticket) stating...commit an offence of probited acitivity on the premises contrary to Trespass to Property Act.With a fine of 65$, no court date and fingerprinting, did not arrest or brought me to station.
I already paid the 65$ fine to Toronto court.
Willing also to pay the fine that the store will ask because of my stupid mistake.
My quetion is...will i still have a record after paying the 65$ fine that the police gave me?
Willmit show in my background check? i was not charge of shoplifting but Tresspass to property act stating only offence on prohibited activity.
Police said its not a criminal charge.
Can i move on with my life after paying the fine and the store fine without worrying of sometings to come up after that?
I was so stressed because i am just holding an open permit not a permanent residence and papers are on process, will immigration know about it?
My freind had ask several lawyers they said i will be fine but still so nervous.
Please i need more advice and ideas. Thank you so much to whoever responds. |

| If the Toronto police said it isnt a criminal charge, then you dont have a record and it wont appear in a background check. You were only handed a ticket and paid a fine. |
