    Can I apply for a state id while I have a warrant and not be arrested?
    Crazy. Ihave an exsiting warrant and need to get a state identification for various reasons; check cashing, entering different places. And such. I wanted to know if I went to my local dmv to purchase one would I be arrested? Do they have the power? Can they even pull up my criminal record? And is that entrapment if they could. because in my state everyone is required to a state id on them at all times. Someone help me?

    There's a possibility whenever ANY Government agency runs your name the outstanding warrant will show and you'll be arrested.

    Yes, they have the authority to call the Police.

    And, no, it's not entrapment.

    You're going to have to clear this warrant up as you can't just keep dodging it for years and years down the road as warrants NEVER expire. Yes, the nice folks down at the DMV will happily call the cops while you are waiting for the id. Whatever your warrant is for, you need to take care of this. Moving to another state, city, whatever is no longer an option. You have really messed up big time if you can't even cash a check. This is not considered entrapment as you are going into their office willingly, hence entrapment is nonexistent in this instance. They don't "pull your criminal record" they check for outstanding warrants. Big difference.

    The DMV is NOT a policing agent and they will not call the police... I just went through this and as a close friend worked for the Indiana DMV for 12 years she assured me they do not run your name.. in fact if you apply for a license and it is suspended they will ask you if you want a state id since you are legally required to carry some form of id. My friend even told me that they have told people their license was suspended only to see them get back in their cars and drive away--and still they can't call the police. Now if you come in and throw hot coffee in someone's face (which happened at her branch) then they WILL call the police ha ha. Other than that you should be fine!
    Ps I know this question was posted awhile ago but I hope this answer helps others who like me googled this very thing for answers--I am so glad to have my state id which gives me time to get money together for a lawyer to help me take care of my situation--good luck!

    Ha ha - you are addressing YOUR State, Indiana.

    This is NOT the case in NY. Your paperwork is confiscated and the Police are notified. As far as leaving without a license and driving away - that doesn't happen here, either. In fact my local DMV is staffed with a Sheriff's Deputy.
