Background Check

My husband had a road rage incident last Dec and was issued 2 citations. We paid the 600.00 tickets and thought that was it.

Now, after working at a job part time for 9 months a full time position opened. He applied and got the offer. Well, that is till they said there was something on his criminal background check that he didn't mention before. So instead of going full time, they dismissed him even after an explanation to them

Question is..... How do we find out WHAT is on the background check? He got 2 tickets and we paid them.... We thought that was the end.

Anyone help?

Did he ask what was on the record in the event it was an error? If he was ticketed and fined, yes, it's on his record. Did he list that arrest on his application? You said that he gave the employer some sort of explanation so he must have had some inkling what it is/was.

If you go to the Police Department with identification and ask them to run a background check on you they will show you what is on your record.

But you go down to the police station and get them to run you a background search.

One ticket was disorderly conduct. I forget what the other one was :-(

From reading on here, it looks like it shouldn't even be on a criminal background check.
I talked to a friend from district court and she said it should not be on there.

And how do they put stuff on your record without you even knowing?

Disorderly conduct is a criminal charge, the "ticket" that was received was in reality a summons to appear in court for the ciminal charge. This is done in many states instead of arresting them, and making them post a bond.

So yes this "ticket" was not really a ticket like on your traffic record but a criminal charge. By just paying it, you were pleading guility, So now your criminal record will show a disorderly conduct criminal charge on it, that you plead guilty to.

And no, all criminal convictions are on your NCIC report ( in the US). And no you should have know it was going to be part of your record ( no one tells you) when you plead guilty to a criminal offense.

Your original post made it sound like he got too traffic tickets, those don't go on the criminal record, but on your driving record. A criminal charge and pleading guility to it, is always on your record.

In my area disorderly conducted is a criminal offense - and whenever you get arrested it goes on your record. It's not a question of sort of asking your permission.

When I do a background check I also pull the V&T records - maybe that's what happened.

Isn't disorderly conduct a volition in ny.
