    Application to Accelerate?
    My boyfriend got a deffered sentence for burglary of an automobile and is on probation. At the beginning of his probation he failed a few UAs but then got completely clean and hasn't failed one since. His probation officer has changed 3 times and the most recent one he got put out a warrant for his arrest for application to accelerate... which I guess means accelerate the case? He has only had one appointment with this new probation officer and she raised the cost of his monthly fines, which he's been having a hard time paying anyway, and is making him go to counseling which is $35 a week. He got the counseling scheduled already and is trying to find a way to get an extension for his community service. We have no clue what to do because she's trying to send him to jail when he hasn't really violated probation he is just having a hard time paying his fines and we can't afford a laywer to get an extension for the community service. His next apointment with the probation officer is Monday and we think she's going to arrest him. She doesn't even know that he knows he has a warrant and he hasn't asked her about it... so I'm just wondering what he should do to avoid going to jail? He's trying really hard to do everything for his probation but financially he can't pay $250 every month. Could anyone tell me how he should go about talking to his probation officer about this? Or is it even possible for her to do that? Or do we have a mixed up meaning of application to accelerate? Any help will be appreciated! Thanks!

    Hello Holly:

    I've never heard of such a charge or motion or whatever it is. But, whatever the warrant is for, he's going to be arrested when he goes.

    If we're only talking dollars here, then the solution should be obvious. But they don't play games. No dollars - no freedom.

    Ok, if he is not paying his monthly fee, and not doing his community service, he has violated the terms of his probation, Some probation officers care less, some are tough as everything.

    And why get an attorney to put off community service, you go do it, weekends, evenings, I can not understand it, but even in Atlanta we had people on minor things, suppose to do 40 hours of community service, not do it, and spend a few days in jail over some littering fine or something.
    Just silly.

    So they issued a warrant, he will be picked up and held pending a hearing to revolk his bond, once that warrant is issued, there is not much else that can happen.

    So he needs to figure out how he can pay the fine and do community service, so when he gets arrested and has a hearing he can explain it to the judge.

    Well his P.O. told him he needed to hire a lawyer to get an extension on the community service... he wasn't trying to avoid it he just needed more time because his job at the time was Mon.-Sat. and the place he was assigned to do community service at only did it on Saturdays and Sundays so it was almost impossible to get 80 hours done in the time he was given... but about the fines... he has been making an effort on his monthly fines but then she raised them more and made it impossible!. Isnt a probation officer supposed to help you? I mean I can understand if he was failing UAs and getting in trouble all the time but it doesn't make any since to me why she would accelerate his case and make him spend 4 years in prison ( which is the length of his deferred sentence) just because he's not able to pay $35 a week to counseling, $60 a month to p.o. $50 a month to victims fund, and $50 a month to court fees. I don't see how anyone can get through this probation stuff... they make it damn near impossible to get out of the system! Grrr

    A person gets through the probation stuff by NOT failing UA's and by reporting for community service... if he can't do those things, you should find another BF, because you will have to deal with him the rest of your life.
