answers about a second time felon

Hi, my boyfriend got out of prison 2 years ago on a 15 split 3 sentence for trafficking. He did 3 years and was out on probation. He stayed out of trouble until a couple months ago when he caught a distribution in another county. Heis now in jail on the probation violation. He has not yet went to court in the other county for the distribution. He went to court on the probation violationa dn they offered him 3 years which he did not take. He does have a lawyer. So what do you think they will give him for the distribution? How much time do you think he will have to do? I heard that he can go back to prison and take SAP RETURN and get back out? I am very concerned because I am 6 1/2 months pregnant and I really want to know how long I will have to go through this by myself. If there is anyone who knows about the prison and has good answers to my question please help me out I would really appreciate it> ThaNKS

You say "distribution", but distribution of WHAT? A couple ounces of pot, or pounds of meth??? How people are sentenced is based on lots of factors, and we have NONE of them except the couple you provided... It wasn't enough... But, it's ok.. Don't start loading us up with stuff.

The bottom line is, nobody knows.

What I DO know, is whatever is going to happen to him, it will be LESS severe if he has lawyer.

In NY city it would probably get dismissed, unless it was a lot of cocaine or heroin. I am not sure where you are. Yet its always bad business to get arrested for dealing while being on parole for dealing. Tell him to shut his mouth and scrape up every penny for a lawyer not a public offender. Every dollar may take a few hours off the sentence.

im sorry, it was uncontrolled substance which was like an 8 ball of powder.

If he did time for sale and while on parole got arrested for selling an 8ball, he definitely gonna do time. That's like spitting the Judge in the eye. How much time? depends on the state. In Louisiana maybe 8 years. In New York maybe 8 months. My best guess would be at least 18 months, and that's the lowest.

Being his second time around in the system, more than likely they will give him some time and not just the 2 years he previously did. Apparently he can't stop dealing and the Judge will sentence him accordingly on this new charge if convicted.
