Okay someone Please help.



My brother is 17 years old, a football/lacrosse/basketball star in highschool and an all around awsome kid.
Sports were his Life. Literally.
He loves to help people in any way he can. ANY way.

One day a girl came up to him and asked him if he knew where to get marijuana. My brother is very popular so he said he could. She said she wanted 4 grams (4 dime bags).
So He made some phonecalls and got what she wanted. She met him later that day and said she only wanted one of the grams. (All of this is happening on school grounds by the way)

Later my brother found out that she'd smoked it and was supposedly Ill in the nurses office. Now, Why you would go to the Nurse's Office after you smoked mari-j on school property is beyond me. So they called her father and her father said he wanted to press charges on my brother after she ratted him out.

So they take him to the main office and they Search him (Without an Officer or Parent/Guardian present) and find the other three grams. They call the police and the other girl goes home Unscathed.

He's had 6 court dates in the past 6 months and is looking at a Legitimate Trial in september. His Birthday is in July, so they're waiting for him to turn 18 for the trial. He may be facing two years in Manchester state Penetentiary.

Now the problem is, my brother admitted to selling these drugs to the girl, but was never read his Mirandas. ALSO, She ingested Drugs on the school's property and nothing happened to her (Yet... *Evil laugh*).

Before all this happened He was a Lacrosse/football/basketball playing, smart kid, with a Bright future and a bunch of Colleges looking out for him. He had two Scholarships and got none of them because of this girl.

We tried to get a petition around the school of all the teachers and students who expressed their feelings about chris and testified what a Good kid he really is.

We got over 8,000 signitures.

The Court officials are saying that it's Inadmissable in court because it doesn't prove that he's a good kid, and has nothing to do with the trial.

Now, i realize this is sheer stupidity, but i need some help. Please, Tell me how i can either get him off the hook, or get his sentance reduced.

Lets deal with the facts first and not the emotions. Your brother was approached to sell an illegal substance. He agreed, got the substance and sold it on school grounds. The buyer testified to sale. Your brother was searched on school grounds and additional quantity of the drug was found on him.

Now look at this objectively. If it was your brother who was the buyer, wouldn't you want the seller (pusher) prosecuted?

Lets address some of your other issues.
1) The buyer has not been punished. That's really immaterial to your brother's case. Whether the buyer is punished or not is up to the school and has no bearing.
2) Your brother was searched without parent or police. I believe there have been a number of cases that have allowed school officials to do this.
3) Your brother wasn't mirandized. All this means is that any statements he made prior to being mirandized may not be used in court. Why would the prosecutors need his statements? They have the testimony of the buyer and the quantity of weed found on him. They don't need his confession or statements.

Bottomline is you aren't going to get your brother off the hook. The police have him pretty much dead to rights. And it looks like the prosecutor wants to make an example of him. So what you need is an attorney who know the local courts and can argue on your brother's behalf. Hopefully get him charged as a juvenile and get probation for a plea bargain.

I concur. Good kids DON'T sell dope to anyone, let alone other kids. He should have known better. Remember D.A.R.E. means Drugs Are Really Expensive in more ways than one can imagine. Your brother is finding this out the hard way. Sorry. I am not very sympathetic about this situation. He certainly knew what he was doing. All he had to tell the girl was "I'm sorry, I can't help you." and his life would be much different now.

Try and get the best attorney your family can afford and see what kind of a plea that can be worked out on his behalf. They have him with the evidence on school property. What is his defense? He has none unfortunately and must face the consequences for his actions.

In re-reading this I'm more than a little surprised that the brother's Attorney has allowed this or, if he's aware of it, hasn't made moves to get it pulled. Talk about making admissions on a public board - !

I am also a little uncomfortable with the "nothing has happened to the girl yet - evil laugh" business.

Threats on a board are never a good idea and this most definitely cannot be helping the brother.

Not a good idea to post this on the internet. You may think it's safe but trust me, not so much, especially because you posted your brothers name. You pretty much gave the prosecution it's case, you admitted that he was guilty, even though he's generally a good kid. Sorry, nothing can be done, you do the crime, you do the time, even if you are a good person.

I will follow up and agree with everyone else, it is your brother so you are only seeing it from a loving sisters position, It is not the girls fault, it is not the schools fault, your brother made the choice to call and get the drugs and bring them to this girl,

And in most states at 17 he could be tried as a adult anyway, with that said if they were going to charge him as a minor that would have been done from the first court date, so if they did not, his turning 18 does not mean anything.

It appears they have a witness against him ( girl) they have evidence he sold, and had more drugs on him. and this was on school property.

My best suggestion is to get the best attorney and make some type of plea agreement
