Violated my PTI program in Florida

I am living in the beautiful state of Florida and was put on the PTI program in Feb 08. Problem is on my second monthly reporting I tested positive for cocaine use. I denied using and my PO informed we that she would send the sample to the lab for confirmation. If she receives confirmation I will be violated two times (1) for testing dirty and the other for lying to my PO. What should I expect? Will I be arrested and put in jail? My other problem is I did NOT use and am not sure why I would've tested positive. Haven't touched the stuff in over 20 years and would hate to have my PTI revoked although to be quite honest it doesn't seem much like relaxed probation since I have to report every month, take drug tests every month even though my crime was NOT drug related, and am not allowed to have alcohol (which is fine cause I'm not a drinker) but it just seems like regular old probation to me.

If you did not do cocaine you can ask that the drug test be readministered. The relaxed probation you refer to does not exist. What you have is a standard monthly reporting that has a drug test thrown in there. They do this so they can catch people who, even though they are arrested and convicted for something else, tend to do drugs or drink alcohol. This IS the standard probation whether you realize it or not.

well on the relaxed, it is not checking in every week, they are not doing random searches of your home, and you are not having the PO come to your work place.

But to a PO, probation is basicly probation, you are a number to them.
But what type of test was it, But if you have not been using, there should be no problem

I have absolutely no problem with having to take a drug test every month. I am just besdie myself that I tested positive for something that I do not do. I was "told" not asked by my PO that they would send the sample to the lab for confirmation and if the outcome is the same I will be violated. What's in store for me if the lab sends positive confirmation that cocaine was/is in my system?

If you didn't use the more sophisticated test won't come back positive so I wouldn't worry about it.

If it is positive, then you did use and you've violated probation.

Hello inn:

You've got a couple problems going on.

In the first place, I dunno what PTI is. I really don't care either. IF it's supposed to be "relaxed", and it isn't, then they've either got you on the wrong probation, or you misunderstood something. I dunno which. I'd find out.

If you're on the wrong probation, then you need to get on the right probation. You may very well need an attorney to do this. Or, you can take it on yourself after you've read the law about PTI, or the probation rules and procedures regarding PTI.

If you haven't read either of those things, I'd get to reading. If you'd rather hire a lawyer, then I'd get to hiring.

It would be my belief, however, that you misunderstood what was going to happen. Or you were lied to. Either one is a distinct possibility.

The next thing is your laid back attitude towards this thing. These people don't "ask". They TELL. If that gun they wear on their hip doesn't offer a clue as to who these people are, then I guess you're gonna need a wake up call.

They LOVE that. And YES, they'll surely do it to you.

About the positive drug test???? Dude, you're either lying, or they switched your test. I don't care which. You won't be the first guy who lied, and you won't be the first guy they switched tests on.

Like I said, they LOVE to make examples, And no, they're not nice people.
