we are boyfriend and girlfriend, but we are legally married

my girlfriend and i are presently legally married, but are not legally seperated. We are expecting a new addition. She is 4 months pregnant. How do we determine the last name of a child?

You are both married with other people?? A few suggestions are her maiden last name and your last name with a hyphen...or your last name.

Well...does she want your last name as the child's last name? if so, all she has to do is put it down on the birth certificate.That simple.

Some states will not allow you to use the real father's name. You must utilize your married name regardless. Check with the Vital Statistics office in your local area

You can name your kid any last name you want so if you want to use the dad's last name
I can't see why you would not be allowed to if he is the biological father that should make it the right thing to do. What states prohibit you from using the father's last name ? I sure never heard that one. Would be interested in their reasoning.
