custody battle with my boyfriend of our daughter

my boyfriend who is not even on the birth certificate has taken my 4 month old daughter, will not let me see her and is taking me to court so he can has full custody i lived with him and took care of my child so i didn't pay bills or work i'm fit mother what are the chances he would get custody? should i be this stressed?

Maybe if you go out and find a job and prove to him that you are to the challenge of rasing your daughter by yourself, you can conquer this mild setback . And I suggest you find a family lawyer to help you out with this.

No, no and again no he does not have the right to take and conceal her. Regardless of whether or not he has filed for custody. Particularly because he is not on the birth certificate he is not even the presumed legal father and therefor you should take the birth certificate, go straight to your local police department and go get her back. Then you should file for custody. As it stands right now technically he has kidnapped her. Go to the police and then straight to a lawyer. He has to prove he is the father legally before he has any legal right to her!!!!!!

God how stupid...you disagree with someone and they have to disagree back because they are pissed without knowing anything.

I am not assuming, that is what you would be doing Tickle. You have to prove paternity first before you have any legal rights as a father! She stated he is not on the birth certificate, she said they are not married so he is not even a presumed father much less a legal father. That is fact! And you need to check yours tickle. If you don't have to prove your paternity or at the very least be on the birth certificate then any man can walk in and claim to be a father and take a child. For that matter anybody can come take any child and say they are the parent. Not to mention, even if you are a legal parent, you do not have the right to keep or conceal a child from any parent without "good cause" or reason to believe the child is in harm, but again you still have to prove you are a legal parent to even do that!

Did he just take the baby or was it court ordered? If he just took the baby then that is parental kidnapping, because if it is not court ordered that he have the baby then the mother automatically has legal custody if you are not married. Call the police if it is not. You will get the baby back providing you are a fit mother.
