    If I sign over all rights of my kids will I have to pay child support?
    I have two children with my ex girlfriend. I had soul custody for about 3 years, I fell on some hard times and wasn't able to provide for them anymore. They have been staying with their mother for about 1 year now, I have a fiancé and a new child now which is causing problems between my ex and my children. My ex has completley turned my children away form me although they still come over every weekend they don't seem to want to be around us anymore. I really can't tolerate this situation and before it gets worse I would like to sign over all rights to their mother but I absolutley can't afford to pay child support. In New York state if I sign over all rights to my children will I HAVE to pay child support?

    If you sign over your rights you will not have to pay child support. But you cannot sign over your rights barring the child's mother being married and her husband wanting to adopt them. There *are* other circumstances but they are rare, usually involving prolonged prison or abuse and are almost always initiated by the custodial parent. Your inability or unwillingness to pay support is not grounds for termination of parental rights. You have an obligation to your children and the court is not going to let you out of it easily.

    Support and right are two separate issues. You don't have to do anything to give up rights, just don't exercise them *period*. But the suppot $$$$ obligations remains in play unless you find someone to adopt the child.

    Man I really hope you are not doing this just to get out of paying child support.

    On a side note, not sure about the rest of the country but here in Indiana they post names and pictures of deadbeat dad's on billboards. I applaud that.
