Getting the father off the birth certifcate

I'm in a situation. My son is 4 years old. His father hasnt seen him since he was 6 months old. He also has 2 other children. Ones a year old and the other one is on the way. He said he wont be a father to my son bc hes a boy but will be father to this new baby bc its a gurl? Make any sense? I want to know wat I have to do to get my son's name last named changed and wat I have to do to get him off the birth certifcate?

Go to courthouse and file for a legal name change.

no you can't get his name off of the birth certificate unless though DNA tests you prove he is not the real father. ( and that is even limited in some states)
Depending on the state you may be able to do a name change, without the fathers permission.

I do hope you have gotten custody agreements in place and are forcing him to pay child support.

I would consider suing for child support even if he says he is not going to pay. There are many ways to ensure you collect a payment. Even if he has no job you will be entitled to part of his income or have to assurance that when he gets a job you money will be deducted from his pay. I would ask for his approval for the name change before you sue for child support .

If the father really doesnt want anything to do with your child, he shouldnt argue with changing your childs name, however check into child support. Taking his name off the birth certificate doesnt erase the past. Your child still needs to know where he came from especially as he gets older. It may seem like you may spare your son pain if he just doesnt know, but that is part of his history as well and he will need to know the truth.

I would tell my son his father was mentally ill and call and speak to a counselor and find out the name of this syndrome ( believe me they will have a name for it or something you can use) so that he would always know that it was his fathers problem and not his, he would be told this from day one if he asked about him . I would never in a day of hell take one damn penny from this idot. Do what you can to protect your son from him. When people get married they just go and change their names at the social security office, this may be all you need to change his name, call them. The birth certificate you can call the bureau of vital statistics where your son was born and ask them questions. Good Luck and bless you and your child
