Father not named on child birth certificate

My Daughters biological father's name is not on her birth certificate, he has just started paying maintenance after 10 yrs...........I am in the process of getting my daughter's surname changed to my married name...........Does her biological father have any right to appose this, he does not have parental custody or a visitation order, we were never married and he does not see my daughter at all, she is 10 yrs old and does not want anything to do with him, so my question is...............Can he appose her name change by deed poll? If he took me to court for access, is my daughter old enough to state she doesn't want to see him and will the court uphold my daughters wishes?

Welcome to AMHD. The biological father most likely has the right to notice that his child's name is being changed, as well as visitation. Did you indicate what state in which you reside?
