| children First I am so sorry for your loss.
And no matter who has the children I hope they are getting counseling to help them come to grips as best they can with the tragic event in thier lives.
Well you lawyer knows best on all these matters. Do they have a temp court order of custody at this point, I will assume they must if they have them in thier home.
But unless she is an awlful person, beleive me being with any loving person is better than the state childrens services which is where they could be given by the court.
If you want legal custody you will need to file in court for that, even visitaton rights will have to be gone though court.
Hearings sadly can take years, so I wish you luck.
Our prayers will be with all the family |

| child custody thanks a lot for just replying chuck that means a lot that there is someone out that even cared enough to read this-maybe you are right about the state
part but i just meant since her daughter murdered my son i just felt as though
she just wasn't much different since she just doesn't want me or his only
brother to even see the children how fair is that-it is because of her daughter
that my son is not here-well neither is her daughter because after she killed
my son she shot her head off-so maybe now you can understand why i am so
very worried about my grandchildren even in the mother's care and yes i am in
the system giving it all i have but none the less since my son's death 3 months ago i have not laid eyes on either of my grandchildren and i just feel
as though the system is failing me terrible well anyways thanks a lot again
for even caring |

| You say she killed her husband (your son), but has that been proven in a court of law yet?
From the sounds of it, she is still awaiting trial, so until then, she is innocent until proven guilty according to the law.
Social Services hasnt removed the kids from the home so perhaps they dont think she is a threat to them.
The best thing for you would be for her to be convicted, but either way, I am sorry for your loss and good luck getting custody.
And remember that if you get visitation, and you start telling the grandkids that mother is a murderer (before it is proven in a court of law), then that could be a bad thing for you. |

| thanks, captain forest, but i think you missed it my dead suicidal daughter-in
law shot her head off after she followed through on the plot she left in a letter and murdered my son-my two grandchildren were taken away by my
daughter-in law mother who was there the day it all happened, she has had
them since, i have tried to make contact with her and so has my son to no
avail to see my two grandchildren but to non avail-yes we are now about to
go to a custody hearing-because recent custody conference there was no
movements, because her mother came to conference late it was for 1:30 and
she waltzed in 2:20pm-i am only saying since all this has happended she has
taken my grandchildren and the system has allowed it-what is her motives
for not letting me see them-i feel as though neither one of us should be with
them since-she has had them for 3 months since my son was murdered by her
suicidal daughter-that's all. once again thank you for caring |

| My bad.
I am sorry, I so misread that.
Should the other grandmother have full custody? Absolutely not. It should be shared b/w you 2 (or at least you should have visitation rights).
Has your lawyer not been able to get a family court judge to award you 50% custody, or at the least, visitation rights for the time being?
And why on Earth would any judge allow the other grandmother to retain custody? Parents always defend their children (as they should) but now the grandkids minds are probably being poisoned with half truths or potentially lies about what happened. |
